Rooted in the Constitution

The patent laws of the United States are firmly rooted in Article I, section 8, of the U.S. Constitution:

“Congress shall have power . . . To promote the progress of science and useful arts, by securing for limited times to authors and inventors the exclusive right to their respective writings and discoveries.”

The patent laws of the United States are further outlined by the U.S. Code in Title 35. The code can be complicated and further compounded by judicial rulings and United States Patent and Trademark Office rules.
